I. Scope of application
The terms and conditions contained in this document will apply to the relationship between the visitor (hereinafter referred to as the “Customer”) and Guest House Casinha Siberiana from the moment the reservation is requested until the moment when the period of hotel accommodation.
II. Execution of the Contract
1. When booking a room, the Client makes an accommodation proposal at Casinha Siberiana, this accommodation is confirmed after full payment of the accommodation in question.
2. The Client is informed that room reservations at Casinha Siberiana made through third parties (tour operators or on internet room reservation portals) are equally valid.
3. Requests for room reservations made directly to Casinha Siberiana or through third parties are not binding and do not oblige Casinha Siberiana to enter into a contract with the Client. Casinha Siberiana will always have the right to refuse to enter into a contract and provide a room at its sole and discretionary discretion.
4. Casinha Siberiana only guarantees to the Client the availability of a room of the reserved category and not the availability of a specific Guest House room.
III. Types of Reservations and respective cancellation
1. On the Guest House Casinha Siberiana website, the Client can make a type of reservation, “guaranteed reservation” after payment.
2. The customer can also make the reservation via telephone, mail or third-party websites. This reserve is called “free reserve”.
3. The Guaranteed Reservation can be canceled by the Customer at any time, and all cancellations that occur 72 hours before check-in time will be fully invoiced and will not be refunded. Any canceled Guaranteed Reservation, which occurs in the period prior to the 72 hours prior to the Customer’s arrival, will be refunded in full, using the Customer’s payment method for reimbursement.
4. The free reservation can be canceled by the Client, and for this purpose, he must contact the Guest House Casinha Siberiana, by e-mail or by telephone. Free reservations made through third-party websites are subject to their conditions.
5. The guaranteed and free reservation will automatically expire if the Client does not show up until 8 pm on the day of the reservation, in which case Casinha Siberiana may immediately make the reserved room available to any other Client without the Client who made the reservation being able to claim any compensation from the Siberian House in any way whatsoever.
IV. Arrival and departure
1. Casinha Siberiana will make available to the Client the room of the reserved category from the date of arrival or, if the Client has not made a reservation and hires the accommodation at the hotel reception, it will be allocated, depending on the desired category and according to the Guest House availability.
2. Upon arrival, the Customer must immediately pay the price due for the room, number of nights of stay, except for payment already made through the website “casinhasiberiana.pt” or third-party websites.
3. Upon full payment of the price, Casinha Siberiana will provide the Client with a room that will remain valid during the contracted period of stay.
4. On the date of departure the Client will have to leave the room unoccupied of people and goods and without any damages until 11 am.
5. If the room is not left until 11 am on the day of departure, compensation corresponding to the price of a one night stay at the Guest House will be immediately charged, with the right to use the room only during this period if the hotel has availability of rooms, otherwise you will have to pay the compensation and leave the room as soon as possible.
V. Animals
1. It is expressly forbidden to access the dog park without the owners present.
2. All authorized interactions with the pack must be carried out in a respectful manner with the pack.
VI. Terms of Use
1. Only the persons indicated in the accommodation booking will be entitled to use the Guest House room.
2. Guests must treat the room with care and consideration.
3. The Client must treat other clients with consideration and respect the posted rules, if any, which are also part of the accommodation contract.
4. Children under 12 years of age must be supervised by an adult Guest at all times during their stay.
5. The Client is strongly advised not to keep or leave without any money, jewelry, valuables or other valuable items left in the room or in vehicles parked in the Siberian House.
8. Casinha Siberiana assumes no responsibility in case of theft, loss or deterioration of valuables such as money, jewelry or other objects of considerable value if such events take place in the hotel room or inside the vehicles parked in the car park. parking.
VII. Access to the Guest House
Casinha Siberiana and its staff will have the right to enter the room during the Client’s stay in order to carry out cleaning, repairs and similar work.
VIII. Price of stay and other prices
1. The price of the stay to be paid by the Client constitutes the consideration for the availability of the use of the Guest House room, in the period between arrival and departure.
2. The total price of the stay will be charged per night, regardless of whether the Client actually made use of the room or spent the night there.
3. The applicable rates are the agreed prices or the price indicated by Casinha Siberiana from prices in force on the date of conclusion of the contract.
4. The fees and amounts indicated in the terms and in the accommodation contract are all inclusive of VAT, unless expressly stated otherwise.
IX. Payment terms
1. Amount of stay and prices for additional services must be paid in advance or when the Client arrives at the Guest House, regardless of the billing date.
2. Casinha Siberiana accepts payment in euros, Paypal, CE Maestro, Visa Electron and credit cards: Visa, MasterCard and American Express.
X. Complaints regarding material defects
1. The Client must inspect the room upon arrival and immediately report any defects found at the Guest House reception.
2. Any defects that may arise during the stay must be reported to the Guest House reception as soon as the Client becomes aware of them.
3. If there is indeed a defect in the Client’s room, Casinha Siberiana has the right to choose between repairing it and relocating the Client to a room that has at least the same category as contracted with the Client.
4. For the purposes mentioned above, only serious defects will be considered and capable of jeopardizing the level of service and quality. do not conflict with the minimum contracted service level.
5. If Casinha Siberiana does not have the means to repair the relevant defect or replace the Client’s room with another of an equivalent or higher category, the Client may only terminate the contract and receive the price paid for the room, nothing more.
XI. Responsibility of Casinha Siberiana
1. Casinha Siberiana will only be liable for damages or losses to the Client when such facts result from Casinha Siberiana’s fault.
2. Casinha Siberiana does not assume any responsibility for loss of data provided by the Customer in case of electronic transmission of payment data, being only responsible in the event of culpable action.
3. Casinha Siberiana does not assume any responsibility for damages or accidents that occur inside the room or any part of the Guest House, unless such accidents are caused by the Siberian House’s fault.
4. Casinha Siberiana will not be held liable towards the Client in case of delay in the availability of the room, as long as there is a valid reason for not making the room available on time.
5. For the purposes of the previous number, valid reasons that make it impossible or more difficult to provide the room, such as, in particular, strikes, blockages, natural disasters, accidents in the room or Guest House will be considered.
6. In case of delay in the availability of the room beyond 19:00 on the day of the reservation, the Client may freely terminate the contract without being entitled to demand any compensation from Casinha Siberiana in any capacity.
7. Casinha Siberiana does not assume any responsibility for acts performed by any worker, unless he is in his normal working period, duly identified and in uniform as a worker of the company.
8. Casinha Siberiana assumes no responsibility and cannot, in any case, be held liable for non-compliance with accessory obligations.
9. Casinha Siberiana cannot, in any case, be held responsible for the act or omission of any other Client, even if it is likely to cause damage or loss to another Client. Any and all damages caused to third parties by Customers will be their sole responsibility and completely strangers to Casinha Siberiana.
10. Casinha Siberiana assumes no responsibility towards the Client for any loss of profits or indirect losses, even if resulting from non-fulfillment of the main obligation.
XII. Notification duty
In the event of theft or damage to property or, in the event of fire, water damage or other damage to the hotel room, the Guest must immediately inform the Guest House staff and do everything possible to help resolve the theft or damage repair.
XIV. End of the accommodation contract
1. Casinha Siberiana has the right to terminate the accommodation contract if the Client does not pay the price in full and on time when it is due or does not provide the required guarantee.
2. The Client may notify the termination of the accommodation contract during his/her stay at any time until 20:00, to take effect from 11:00 on the following day.
3. Any contracting party may terminate the accommodation contract summarily for just cause.
4. Casinha Siberiana will have the right to immediately terminate the accommodation contract for just cause if the Client has any behavior that affects good coexistence, peace or hygiene, namely if during his stay, the Client is under the influence of drugs or alcohol, use the room for prostitution, act offensively towards staff or other guests, disturb the peace of other guests, or, in the past, have made maliciously false reservations and/or damaged or destroyed the Guest House or its installations.
V. Data protection
1. The Client is informed that his/her personal data will be stored and processed by Casinha Siberiana and selected service providers, in accordance with the Law, for the purpose of executing the contract, for the services to the Client and for its eventual own advertising campaigns.
2. The Customer grants Casinha Siberiana the right to use associated companies and selected service providers to carry out the data processing and the right to transmit such personal data under this section to the companies that allow them to store and process.
3. The Customer has the right to object at any time to the use of personal data for advertising purposes, and must therefore inform Casinha Siberiana of this intention in writing.
4. Unless otherwise specified, the Customer’s personal data must be deleted when the accommodation contract ends and the legal retention periods have expired.
XVI. General provisions
1. The Terms and Conditions fully regulate the Client’s stay at the Guest House and the use of the room by the Client.
2. No verbal agreement was reached during the accommodation contract, any and all changes to the contract between the parties will necessarily have to be included in a written document signed by both, unless it is a unilateral declaration, in which case it must be included in a written document signed by the issuer.
3. Casinha Siberiana will have the right to have third parties perform its obligations under and within the scope of the accommodation contract.
4. The nullity of one or more of the previous provisions does not affect the validity of the remaining provisions. The invalid provision will be replaced by the valid provision, the closest to the commercial and legal intentions of the parties or if this is not possible by the Portuguese legislation in force.
